Data space protocol: State OFFERED

Hi team,
according to the data space protocol state machine the OFFERED state is the following:

(OFFERED: The Provider has sent an Offer to the Consumer and the Consumer has sent an ACK response.)

This description indicates that an offer by a provider is not legally binding but will be accepted after the acceptance of the consumer. In practical application normally an offer is signed and directly legally binding under the described conditions and is accepted by the consumer?

I can't give legal advice here. But from the technical standpoint, the ContractAgreement object only materializes when the Data Provider has sent a ContractAgreementMessage. Only given the included agreementId, the Consumer can start the Transfer Process Protocol. Does that answer the question?
